The Supreme Court (SC) on Thursday declared the Federal Service Tribunal\u2019s decision on the seniority of railway officers null and void.<\/p>\n\n\n\n
In a seven-page verdict, authored by Justice Ayesha A. Malik, it was said that Service Rules, 1990 would apply only to probationary stage, and that decades old departmental traditions and seniority based on CSS exams could not be ignored. <\/p>\n\n\n\n
It was further stated that the seniority of civil servants granted promotion after having completed their probation period would not be affected. <\/p>\n\n\n\n
The apex court said that changes in old seniority lists by the railway department was illegal.<\/p>\n\n\n\n
It went on to say that for decades the department had been determining the seniority of officers on the basis of their performance in the CSS exams. <\/p>\n\n\n\n
On August 27, 2014, the department had issued a revised seniority list, which the service tribunal and the Supreme Court later annulled. <\/p>\n\n\n\n
The department then on June 29, 2022 and March 20, 2023 issued the lists based on CSS exams following which the officers filed appeals in the tribunal against these lists. <\/p>\n\n\n\n
The tribunal declared these lists null and void and ordered the compilation of new lists under the rules framed in 1990.<\/p>\n\n\n\n
