{"id":24261,"date":"2026-07-08T18:38:01","date_gmt":"2026-07-08T13:38:01","guid":{"rendered":"https:\/\/pakjazbo.com\/?p=24261"},"modified":"2026-07-08T18:38:02","modified_gmt":"2026-07-08T13:38:02","slug":"federal-constitutional-court-rules-registrar-cannot-reject-petitions-as-non-maintainable","status":"publish","type":"post","link":"https:\/\/pakjazbo.com\/?p=24261","title":{"rendered":"Federal Constitutional Court Rules Registrar Cannot Reject Petitions as Non-Maintainable"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>ISLAMABAD:<\/strong> The Federal Constitutional Court has ruled that the Registrar&#8217;s Office has <strong>no authority to declare constitutional petitions non-maintainable and return them<\/strong>, holding that only the court itself can determine whether a petition is maintainable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice <strong>Hasan Azhar Rizvi<\/strong> issued a <strong>six-page written order<\/strong> while deciding a chamber appeal filed against objections raised by the Registrar&#8217;s Office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court held that questions relating to the maintainability of a petition fall exclusively within the judicial domain and cannot be decided by administrative officials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the ruling, the Registrar&#8217;s Office may raise <strong>only administrative or procedural objections<\/strong> concerning the filing of petitions. It may return a petition only if it has not been filed in accordance with the applicable court rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment emphasized that the Registrar&#8217;s Office cannot exercise judicial powers under any circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court further observed that granting judicial authority to an administrative officer would violate the constitutional principle of the <strong>separation of powers<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also clarified that the Registrar&#8217;s Office has <strong>no authority to label a constitutional petition as frivolous or non-serious<\/strong>, as such determinations can only be made by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling was issued in a chamber appeal filed by <strong>Razia Aslam<\/strong>, whose constitutional petition had been returned by the Registrar&#8217;s Office on <strong>February 14<\/strong> on the ground that it was allegedly non-maintainable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Challenging those objections, the petitioner approached the Federal Constitutional Court through a chamber appeal, which resulted in the present ruling clarifying the limits of the Registrar&#8217;s administrative powers.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>ISLAMABAD: The Federal Constitutional Court has ruled that the Registrar&#8217;s Office has no authority to declare constitutional petitions non-maintainable and return them, holding that only the court itself can determine whether a petition is maintainable.
