The Federal Constitutional Court (FCC) on Monday declared unconstitutional a decision that had declared the elections of the Sindh Secretariat Cooperative Housing Society null and void.<\/p>\n\n\n\n
In its verdict, the court directed the Cooperative Court to resolve the dispute regarding the society’s elections within one month.<\/p>\n\n\n\n
The Federal Constitutional Court held that a constitutional petition cannot be filed in a high court when an alternative legal forum for redress is available.<\/p>\n\n\n\n
The judgment stated that cases involving disputed questions of fact cannot be decided through constitutional writ petitions. It emphasized that facts must be determined by an authorized forum and that high courts, while exercising constitutional jurisdiction, cannot directly determine disputed facts.<\/p>\n\n\n\n
The court observed that where a dispute is based on factual issues, the correct facts can only be established through the recording of evidence by the competent forum.<\/p>\n\n\n\n
According to the verdict, the Sindh Secretariat Cooperative Housing Society elections could have been challenged before the forum authorized under the law and could not have been challenged directly in the Sindh High Court.<\/p>\n\n\n\n
