It added that once candidates participate in the recruitment process, they <strong>cannot later object to the eligibility criteria<\/strong> after failing the test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court further observed that <strong>legal action cannot be maintained under the right of claim after failing the examination<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the ruling, the <strong>Education Department\u2019s 2017 recruitment policy is lawful<\/strong>, and courts generally <strong>do not interfere in policy-making matters<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgment also noted that the <strong>Peshawar High Court\u2019s observation that the provincial education minister\u2019s instructions had no legal status was incorrect<\/strong>, stating that under the <strong>Rules of Business<\/strong>, the provincial education minister has the authority to set recruitment criteria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court said that the trial court <strong>misinterpreted the law by ordering the inclusion of failed candidates in the merit list<\/strong>, and subordinate courts had relied on the <strong>2014 policy, which had already been abolished<\/strong>, instead of the valid 2017 policy.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Islamabad: The Supreme Court of Pakistan has ruled that obtaining at least 40% marks in the National Testing Service (NTS) test is a mandatory requirement for eligibility, overturning the Peshawar High Court order related to the recruitment of Primary School Teacher Recruitment (PST) teachers.
